Your limited liability for damage as a CBYA sailor
Sailing can be an expensive and dangerous leisure activity. The CBYA has, however, agreed favourable terms for every sailor who wants to partake in TOMs sailing or TOMs racing. RCNC obviously insure their TOMs against damage, and like most insurance policies, their policy has an excess. This excess has to be covered by the CBYA in case of negligence on the part of the sailors, and to take this frightening burden away for every sailor, the CBYA has agreed to cover it. However, as a non-profit organisation, funds are limited, and the best solution was to create a special fund.
Since July, every sailor gong out on a TOM has to pay 5€ per sail into this fund, which is held exclusively for damage incurred on a TOM. Over the course of the second half of 2024, about 200€ have been accumulated. In addition to this, 20€ must be paid directly to RCNC to cover the boat rental. To make it clear: With these 5€ per sailor and sail, the TOMs sailors have covered their liability to the CBYA and to RCNC.
So theres no reason to let liability for damage hold you back from enjoying TOM sailing.
Happy sailing.
